Felippe Ramos will present: “Politics wearing court dress: Brazil’s 2016 impeachment as a dualism of law and politics”.
Abstract
Brazil just underwent a controversial impeachment process that ousted president Dilma Rousseff from office. The technical charges raised against her were widely perceived as an excuse to replace the administration and solve a crisis of governability generated by a convergence of multiple crises. Rousseff’s supporters argued that an impeachment based on an excuse amounted to a coup d’état. In strictly constitutional and legal terms, however, such a maneuver is allowed, even though it may deepen a democratic deficit and cause further sources of political instability. The paper discusses, then, the grounds for the constitutional legality (law) of the impeachment alongside with the questions regarding its democratic legitimacy (politics).
